What is Dual / Designated Agency?

     Dual / designated agency occurs when one agent / company attempts to represent both the seller and the buyer in the same transaction.

     It has been compared to having the same attorney represent both the plaintiff and defendant in the same court case. Or imagine a couple getting divorced. It would be like the husband hiring the same attorney that is representing his wife. The two sides have exact opposite goals. Obviously, this will never work. It's the buyer that ends up on the short end of the deal. The buyer is left unrepresented as the dual agent, who owes his loyalty to the seller, desperately works to ensure the deal closes so that he can receive a double commission 

 

What is an Exclusive Buyers Agency?

     It's a company whose agents ONLY represent buyers. They NEVER represent sellers (never take listings). This ensures that their clients will never be faced with dual / designated agency.

 

What is the difference between a "buyer's agent and an "Exclusive buyers agent?"

     A "buyer's agent" works for a traditional real estate company that also represents sellers. Therefore they can engage in dual / designated agency. If you were working with a "buyer's agent" from a traditional real estate company and you fell in love with a home that was listed by that agent or that company you would be forced into dual / designated agency.

    An "Exclusive buyers agent" works for a company that doesn't have any listings, they never work for sellers. Therefore, the possibility of dual / designated agency is eliminated. We only work for the buyer !!! Remember: It must say "Exclusive."

LA Listing Agent


These are the Ordinary Agents you call when you see a sign in a yard of a home for sale, or when you call about an ad you see in the newspaper, or when you walk into an open house on Sunday afternoon. These Agents are obligated to get the best price for the seller. These Agents become "Dual Agents" if they represent a buyer on the sale of one of their company's listings.

Everyone now wants to call themselves a "Buyer's Agent". Buyer's Agents that work in a regular real estate office which takes listings can indeed represent a buyer, but if that buyer wants to see a home listed by the same company, then the buyer's agent becomes a dual agent representing both the buyer and the seller. How can someone fully represent two opposing parties at the same time? THEY CAN'T!
